CityDwelling is a property search and rental platform that connects tenants with landlords and property owners. Our services include:

• Property search and discovery
• Saved property collections
• Viewing request coordination
• Communication between tenants and landlords
• Property recommendations and personalization

3. User Accounts

3.1 Account Creation

• You must be at least 18 years old to create an account
• You must provide accurate and complete information
• You are responsible for maintaining the confidentiality of your password
• You are responsible for all activities under your account

3.2 Account Security

You must notify us immediately of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized account access.

4. User Conduct

You agree NOT to:

• Provide false or misleading information
• Impersonate any person or entity
• Use the platform for illegal purposes
• Harass, abuse, or harm other users
• Scrape or collect data without permission
• Attempt to gain unauthorized access to our systems
• Upload viruses or malicious code
• Violate any applicable laws or regulations

5. Property Listings

5.1 Accuracy

While we strive to ensure property information is accurate, we do not guarantee the accuracy, completeness, or availability of any listing. Property owners are responsible for the accuracy of their listings.

5.2 No Guarantee of Availability

Properties listed on our platform may become unavailable at any time. We are not responsible if a property you're interested in is no longer available.

6. Subscription Plans and Payments

6.1 Free and Premium Plans

CityDwelling offers both free and premium subscription plans with different feature access:

• Free Plan: Limited searches, basic property viewing
• Premium Plans: Unlimited searches, exclusive listings, priority support

6.2 Payment Terms

• Subscription fees are billed in advance
• Payments are processed through secure third-party payment processors (Paystack)
• All fees are non-refundable unless required by law
• We reserve the right to change pricing with 30 days notice

6.3 Auto-Renewal

Subscriptions automatically renew unless cancelled before the renewal date. You can cancel anytime from your account settings.

7. Intellectual Property

7.1 Our Content

All content on CityDwelling, including text, graphics, logos, and software, is owned by us or our licensors and protected by intellectual property laws.

7.2 User Content

By submitting content (reviews, comments, saved properties), you grant us a non-exclusive, worldwide license to use, display, and distribute that content in connection with our services.

8. Third-Party Services

Our platform integrates with third-party services (Mixpanel for analytics, Paystack for payments, etc.). Your use of these services is subject to their respective terms and privacy policies.

9. Disclaimers and Limitations of Liability

9.1 "As Is" Service

CityDwelling is provided "as is" without warranties of any kind, either express or implied. We do not guarantee uninterrupted or error-free service.

9.2 Not a Party to Transactions

CityDwelling is a platform that facilitates connections. We are not a party to any rental agreements between tenants and landlords. We are not responsible for:

• Disputes between users
• Property condition or misrepresentation
• Fraud or illegal activities by users
• Financial losses from rental transactions

9.3 Limitation of Liability

To the maximum extent permitted by law, CityDwelling and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.

10. Indemnification

You agree to indemnify and hold harmless CityDwelling from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform or violation of these terms.

11. Termination

We may suspend or terminate your account at any time for:

• Violation of these terms
• Fraudulent or illegal activity
• Non-payment of subscription fees
• At our sole discretion

You may delete your account at any time from your account settings.

12. Dispute Resolution

12.1 Governing Law

These terms are governed by the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts in Nairobi, Kenya.

12.2 Arbitration

For disputes under KES 500,000, you agree to first attempt to resolve the dispute through good faith negotiation. If unresolved within 30 days, the dispute may be submitted to binding arbitration.

13. Changes to Terms

We may modify these terms at any time. We will notify you of material changes via email or through a prominent notice on the platform. Your continued use after changes constitutes acceptance of the new terms.

14. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
